The Divorce Process-Their Approach and Ours

The typical litigated divorce by standard, is adversarial in nature. The process is meant to place the two parties at odds with each other to create a win-lose situation.  The process may create a negative atmosphere where negotiation immediately becomes contentious and in many cases, halts progress. The judge's decision is final and when children are involved, can create a final outcome that is painful, and unfair and may cause future harm to the family dynamic and relationships.

The parties relinquish control to their attorneys and leave the outcome to a judge who makes a determination of your situation based on his/her past case history, disregarding the uniqueness of your situation.

Attorney fees can be in the range of $300-$500 an hour or more per party. Add to that the cost of court fees. It is not unheard of for parties to expect to pay upwards of tens of thousands of dollars for a final judgment they find unfavorable. You are left feeling financially drained and emotionally damaged.

As you conduct your research on other divorce mediators, ask if they have additional charges if you have a house, car, and/or children. In many cases, you will be charged additional fees the more "complicated" your case becomes. Also, they expect you to do the work and provide the stipulations for your divorce so all they do is prepare the Divorce Decree. Be cautious!
